Judicial proceedings, including collusion investigations, further contribute to the timeline, compounded by factors such as residency issues, the court’s heavy dockets, witness availability, and legal counsel’s heavy workload.
What are the rights of a person who gets arrested?
A person who gets arrested has the right to be informed of Miranda rights. These include the right to remain silent, by which one cannot be compelled to answer any questions propounded by the arresting officer. One must be duly informed that anything he/she says can and will be used against him/her in a court of law. The arrested person shall not be forced to write and sign any extrajudicial confession. To ensure these rights, he/she is accorded the freedom to choose his/her own counsel who shall assist him/her as early as the time of arrest until the trial of the case where the proper defense shall be established. If one cannot afford the services of a private lawyer, he/she must be provided with competent and independent counsel by the state.
